BrandForce Terms of Service

1. Acceptance of Terms

By accessing or using BrandForce (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the App.

2. Service Description

BrandForce is an influencer discovery and management platform that enables users to search, analyze, and organize social media influencers, primarily on Instagram.

The App aggregates and analyzes publicly available information, including but not limited to influencer profiles, content, engagement metrics, and audience insights, sourced from public social media pages, third-party data providers, and user inputs.

While we make reasonable efforts to keep information accurate and up to date, BrandForce does not guarantee the accuracy, completeness, or timeliness of any data. Influencer metrics may change frequently and should not be relied upon as definitive or guaranteed performance indicators.

Users may report suspected inaccuracies through the App’s feedback or support channels, and we may review such reports at our discretion.

3. Account Responsibilities

Registration

You must provide accurate, current, and complete information when creating an account.

Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

Prohibited Account Use

  • Share, resell, or transfer your account to others
  • Create multiple accounts to circumvent usage limits
  • Use automated tools, bots, or scripts to access or extract data without authorization

Violations may result in suspension or termination without notice.

4. Intellectual Property

All rights, title, and interest in and to the App—including software, algorithms, databases, UI design, trademarks, logos, and content—are owned by BrandForce or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for internal business or personal marketing purposes.

You may not:

  • Copy, reproduce, sell, sublicense, or distribute any part of the App
  • Reverse engineer, decompile, or attempt to extract source code
  • Use App data to build competing products or services

5. Prohibited Activities

You agree not to use the App to:

  • Violate any applicable laws, regulations, or platform policies
  • Harass, spam, or misrepresent yourself to influencers
  • Scrape, harvest, or export data at scale beyond permitted limits
  • Circumvent rate limits, access controls, or security measures
  • Introduce malware, malicious code, or excessive automated traffic

Bulk data extraction (such as exporting or copying large volumes of influencer records) without written authorization is strictly prohibited.

6. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms, including after warnings for minor violations or immediately for severe or repeated violations.

If your account is suspended, you may submit an appeal within 7 days by contacting [email protected]. Reinstatement is not guaranteed.

7. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to accuracy or reliability of influencer data, uninterrupted operation, and suitability for specific business outcomes.

BrandForce does not guarantee campaign results, influencer performance, or return on investment (ROI).

8. Limitation of Liability

To the fullest extent permitted by law, BrandForce shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, or damages arising from reliance on influencer data or third-party platforms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your applicable jurisdiction, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in that jurisdiction. Where permitted, international users may elect binding arbitration as an alternative dispute resolution method.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be notified at least 30 days in advance via email or in-app notice. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

The latest version will always be available in the App’s Legal section.
